Ratt's official Facebook continues to be a cavalcade of unintentional comedy. This weekend Blotz crowed about Ratt playing at the "Rockin' The Rivers" festival which apparently drew 35,000 attendees... but failed to mention that most of them were likely there for the evening's headliner, country hottie Miranda Lambert. Laughing very hard

My mistake: Blotz-o-Ratt opened for Miranda Lambert @ the Buffalo Chip in Sturgis, N.D., not at the Rockin' Rivers festival.

Still, I'm sure the majority of the ticket buyers were there to see Miranda, not Blotz and the Shotz. Very Happy

Here is the real question..

God, I hate how easily crap information gets spread around the internet.

No, they are not playing to packed houses, unless it's a damn small house on their own, or a big house with other headliners.

No, the courts haven't awarded the name to Blotzer, and no, Blotzer hasn't withstood multiple court challenges. The name belongs to Bobby and Warren. It did before this mess started, and it does now. Bobby's only court victory has been the court's refusal to enter an injunction to stop his use of the name. That is only a temporary matter. That is not a final verdict in any of the ongoing litigation. All it means is that the court won't stop Bobby from touring as Ratt while the litigation plays out. Nothing has been settled. By the same rationale on the part of the court, Warren could also tour using the name with a different lineup.

Those are the facts. Moving from fact to opinion, I don't think Warren will tour, because he actually gives a damn about the band and it's future marketability. I believe he will wait until there are final rulings in the litigation before touring to prevent further dilution of his brand. Final resolution could come through a court order, or through a settlement. If it can be done quickly, I'd like to see Warren bring Stephen and Juan into a legal entity, buy out Bobby, and move along. Bobby would get his payday, and the world would get Ratt, with its true creative leaders...Warren and Stephen. No, Stephen can't sing. He never could. He can write, and Warren can write and play. That's the core of Ratt. However, the longer Bobby drags this out, and continues to allow the band to be seen as a joke, the less value there remains for Warren, with or without anyone else, to buy out.

Bobby does not have the creative ability, or the personality, to create a significant musical payday apart from the Ratt name. He also doesn't appear to have the financial stability to wait while things play out. Warren does. Bobby should quit raping the Ratt name and negotiate a deal while there is still value to be had.

As a footnote, none of this has anything to do with whether Josh Alan can sing or not. He can. So can a lot of other people. That doesn't transform any of their bands into Ratt.

Yes it more or less does that, Bobby comes off as egotistical and arrogant in his book whenever he's trashing other people outside of Ratt like Don Dokken and Jack Russell. That's too bad because otherwise it's a fun read.

Thank you clearing that up, Blotzer made it sound like they he won and it was over.

Stephen Pearcy never claimed to be a great singer, but he was a great frontman, could write a catch melody, and thanks to being one of the main songwriters in the band, and holding on to his publishing he has never had to resort to being a man who sells candy from vending machines.

Tonight on the Eddie Trunk show Y&T frontman Dave Meneketti said former Y&T drummer Stef Burns will be the official drummer for the Pearcy/DeMartini/Croucier version of Ratt...

Assuming that means Jimmy Degrasso on drums. Stef Burns is a guitarist. Jimmy did fill in with Ratt for a show or two a few years back when Bobby was having health issues. Interesting. Brad Lang is playing bass in Bobby's version, so there are Y&T connections to both versions. This is good news to me. Jimmy is a hell of a drummer.

As much as I like Ratt, I noticed that it's really unwise to expect too much from the mind of a glam metal musician. They tend to have the intellect of Anna Nicole Smith. Usually, I can tell from a mile away and just by knowing their style, lyrics, art, etc. who is and isn't likely to be fairly bright or insightful in what they have to say. They're just a step above nu-metal and pop-punk artists in their way of thinking.

Looks like Blotzer got his ass handed to him in court and Pearcy, DeMartini and Croucier have reclaimed the Ratt name.

The following statement comes courtesy of Stephen M. Doniger, Esq.:

“After the four remaining original members of Ratt (Pearcy, DeMartini, Croucier and Blotzer) finished touring in 2014, Bobby Blotzer began touring as Bobby Blotzer’s Ratt Experience, and Juan Croucier began touring as Ratt’s Juan Croucier. Realizing that he could make ten times as much per show touring as Ratt, Blotzer relabeled his cover band as Ratt, over the objections of every other member of the band. He then proceeded to get into litigation with each of his three partners in an effort to usurp control of the Ratt name, claiming that WBS owned the band name and he controlled WBS.

A Federal District Court in the Central District of California has now Ordered judgment to be entered against WBS/Blotzer, finding that WBS does not own the Ratt name (WBS, Inc. v. Juan Croucier et al., Case No. 2:15-cv-07251-DDP). Under a 1985 written Ratt Partnership Agreement, the name/trademarks are the property of the partnership and can only be transferred with the unanimous approval of all partners. Thus, in 1997 when Blotzer, DeMartini and Pearcy purported to transfer the trademarks to WBS, that transfer was invalid since Juan Croucier (Ratt bassist) whom was still a partner, and never advised of, let alone consented to, the transfer. Thus, the partnership still owns the Ratt name.

Pearcy, DeMartini and Croucier have also expelled Blotzer from the partnership. Blotzer thus has no further interest in the Ratt name and may now only refer to himself as a “former member of Ratt” as per the partnership agreement. Stephen Pearcy posted on his twitter account that they will be back in 2017. It seems reasonable to believe given this court ruling, the fact that they have now formally/legally "expelled" Bobby, and that they performed as the "surprise band" on the recent MoR Cruise. I have to imagine they are a contender for headliner at the 2017 M3 Festival, especially if Poison doesn't get it together and confirm a reunion tour like Bret has been hinting at.

Stephen is not a great live vocalist but his style and persona as a performer are entertaining enough for me. And the Warren/Carlos due works really well. I'd be up for seeing them again. I'm also interested in hearing what material they came up with before they split the last time. Apparently it was in the vein of Infestation which I liked quite a bit.

This is my favorite quote,  "Although a reasonable trier of fact could not conclude, on this record, that the napkin alone sufficed to signify or inform the other members of the RATT Partnership of Pearcy’s voluntary departure from the Partnership, it does, in conjunction with his 1995 disavowal of the continued existence of the Partnership, create a triable issue of fact as to his partnership status at the time of the 1997 assignment to WBS."  

Somebody actually saved a napkin from 1992! What a world.

Shortly after officially announcing their heavily rumored reunion, the latest Ratt lineup has booked its first major live performance: a headlining slot at the M3 Rock Festival in Columbia, Md.
As previously reported, singer Stephen Pearcy, guitarist Warren DeMartini and bassist Juan Croucier recently prevailed in a legal tug-of-war over the band name with drummer Bobby Blotzer, who’d been touring with his own version of the group while contending that DeMartini — with whom he shared control of the corporation with ownership of Ratt’s copyrights — had breached his fiduciary duty by neglecting to tour or record.

Interesting turnabout, though. I hope these guys did this to carry on as the band and record new music, and not just to dick over Blotzer.

Blotzer should just change his band name to Bratt. Haha.

I guess they must have someone in their camp who saves everything that can possibly be used as evidence at a later date, cuz obviously none of them trust each other worth a damn. If Stephen Pearcy's book is to be believed, that mistrust goes back years and years... I got the feeling that none of the guys in the band ever really liked each other very much, even when Ratt was at its peak of popularity.

I guess they were like the Ramones - they hated each other's guts for most of their existence but they insisted on staying together just cuz it was all they knew how to do. Very Happy
